Terms of Service

1. Acceptance of terms

By creating an account or using handwritten.md (the “Service”) you agree to these Terms of Service. If you don't agree, don't use the Service. If you use the Service on behalf of an organisation, you represent that you have authority to bind that organisation.

2. The service

handwritten.md transcribes photos and PDFs of handwritten notebook pages into Markdown files compatible with the Obsidian note-taking app. Output is generated by large language models (currently Google Gemini) and may contain errors. You are responsible for reviewing the output before relying on it.

3. Your account

You are responsible for keeping your login credentials secure and for all activity that happens under your account. Notify us immediately if you suspect unauthorised access. You must be at least 13 years old (16 in the EU) to create an account.

4. Acceptable use

You agree not to:

  • Upload content that is illegal, infringes third-party rights, or that you do not have rights to.
  • Upload content depicting child sexual abuse material — such uploads are reported to NCMEC and law enforcement and result in immediate account termination.
  • Attempt to circumvent quotas, rate limits, or any technical measures of the Service.
  • Use the Service to harass, defame, or harm others, or to process content you obtained without consent.
  • Probe, scan, or test the vulnerability of the Service without our express permission. Please contact us if you want to report a security issue.

5. Subscriptions and billing

  • Paid plans are billed monthly or yearly via Stripe. Your card will be automatically renewed at the start of each billing period until you cancel.
  • Overage usage on Personal and Heavy plans is metered at $0.10 per page and capped at $20/month and $50/month respectively. We will never bill above the cap.
  • You may cancel any time from the customer portal. Cancellation takes effect at the end of the current billing period; we do not pro-rate cancellations.
  • 30-day money-back guarantee. If you are not satisfied within 30 days of your first paid charge, email legal@handwritten.md for a full refund.
  • Prices may change with 30 days' notice. Existing yearly subscribers keep their price for the remainder of their term.
  • Taxes (VAT, sales tax) are calculated and remitted by Stripe where required.

6. Intellectual property

You own your content. You retain all rights to the photos and PDFs you upload and to the Markdown files we generate from them. You grant us a limited, temporary licence to process your content solely to provide the Service. That licence ends when the content is purged (within 60 minutes). We never use your content to train models.

We retain ownership of the Service itself — software, design, prompts, branding, and infrastructure.

7. Warranty disclaimer

The Service is provided “as is” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Transcription is performed by AI models and may be inaccurate. Do not rely on the Service for safety-critical, legal, or medical decisions.

8. Limitation of liability

To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service will not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater. We are not liable for indirect, incidental, special, consequential, or punitive damages.

9. Termination

You may terminate your account at any time from Settings → Data. We may suspend or terminate your access if you breach these Terms or use the Service in a way that risks harm to other users or to the Service. We will give you reasonable notice and a chance to cure unless the breach is material or egregious.

10. Governing law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of laws principles. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Florida, and you consent to the personal jurisdiction of those courts.

11. Changes

We may update these Terms from time to time. If the changes are material we will notify you by email and post the updated date at the top of this page. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.
